Responsibility for safety devices:
The legal responsibility for installing, maintaining, inspecting, and replacing child safety devices depends on the circumstances, including who owns, occupies, and manages the property, together with any applicable legal obligations.
After installation:
Where a child safety device has been correctly installed and is subsequently removed, damaged, disabled, by another person, the responsibility for maintaining or replacing the device will generally rest with the person responsible for the property at that time.
Liability:
If an accident occurs after a child safety device has been deliberately removed, disabled, damaged, or otherwise interfered with by someone, the installer will not be responsible for any resulting non-compliance or injury
Rental properties:
Landlords generally have legal duties to provide and maintain a reasonably safe property. While there is no specific legal requirement placing ongoing blind safety obligations solely on tenants, tenancy agreements may require tenants not to remove or interfere with safety devices and to report any missing or damaged devices promptly.
